Terms & Conditions of Business

This agreement is between "Eton Nannies Ltd”(‘The service provider’) and the client (‘The Family’). These terms and conditions represent a legally binding contract between the Family and the service provider.

The verbal or written instruction by the Family to the service provider to proceed with a suitable candidate from the service provider constitutes acceptance by the The Family of these terms and conditions, which are non-negotiable. All reference to a ‘Nanny’ means a Nanny or Person employed by the service provider. All reference to a ‘Babysitter’ means a Babysitter or Person employed by the service provider.

The Family agrees to notify the service provider that:

- a candidate is present or not at work (i.e. the Family home) when the contract has begun

- they wish to extend the contract of service 3 months prior to the previous contract ending

Fees

Agreed fees are payable directly from the Family to the service provider. There is a non- refundable £100+VAT administration fee for all agreed contracts. This is only payable if the Family decide to take one of the nannies or babysitters employed by the service provider.

Duration of contract

The service provider does not offer temporary bookings. That is, the service provider will not offer bookings to the Family for any less than 1 year.

Start and finish dates for bookings are confirmed at point of contract finalisation (before the service provider provdies their nanny or babysitter to the Family). If required, renewals will be discussed between the Family and the service provider, 3 months prior to the ending of the first 12 months.

Payment terms

Invoices are generated once an offer of contract has been made and accepted by the Family. All invoices are payable to the service provider within 5 days in order to confirm the booking or 48hrs prior to the role commencement, whichever is earlier.

If payment has not been received within 5 days of the offer of employment, the service provider may decide to assign another placement for the Nanny or Babysitter in order to limit the Nannies’ or Babysitters’ salary costs to the service provider.

Unpaid accounts will incur all collection costs.

Tax and administration

Unlike other childcare service companies, the service provider is not an agency. Rather, the service provider is the Employer and is responsible for the administration and payment of the Nannies’ tax, pension and national insurance contributions. This is not the responsibility of the Family.

General

These Terms and Conditions of Business shall be governed by and construed in all respects in accordance with the laws of England and the Family agrees to submit to the exclusive jurisdiction of the English courts.

Public Liability Insurance

The service provider holds Public Liability insurance with a minimum limit of £5M.
